These Terms of Use ("Terms") govern your access to and use of the FoundryPay website at getfoundrypay.com (the "Site") and our early access waitlist. By using the Site or joining the waitlist, you agree to these Terms. FoundryPay is currently operated by Nick, an individual operating under the name FoundryPay ("FoundryPay," "we," "us," or "our").

FoundryPay is pre-launch and informational only. Nothing on this Site is an offer to provide financing, a loan, factoring, securities, or any other financial product or service. No financial product is currently available, and joining the waitlist does not create any obligation or guarantee of future service.

01 The Site is informational

The Site describes a product we are building. Any descriptions of funding speed, fees, rates, or features reflect our current plans and are subject to change. They are not commitments, offers, or guarantees, and they do not constitute financial, legal, or investment advice.

02 The waitlist

Joining the early access waitlist lets us contact you about FoundryPay. It does not guarantee that you will be offered any product, that any product will launch, or the terms on which any future product might be offered. We may contact, prioritize, or decline waitlist members at our discretion.

The Site and its content — including the FoundryPay name, logo, text, and design — belong to FoundryPay and are protected by applicable laws. You may not copy, reproduce, or reuse them without our permission.

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

06 Limitation of liability

To the fullest extent permitted by law, FoundryPay will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Site or the waitlist.

07 Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms as FoundryPay develops, particularly before launching any financial product. Changes take effect when posted, and the "Last updated" date above will reflect them.

08 Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any disputes relating to the Site or these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Arizona.
